Maharashtra Pollution Control Board (MPCB) is enforcing various environmental laws in the state of Maharashtra. Water (Prevention and Control of Pollution) Act, 1974, Air (Prevention and Control of Pollution) Act, 1981, and Water Act, 1977 are the three main acts. The Maharashtra Pollution Control Board is primarily under the administrative control of the Maharashtra Government’s Environment Department.

The following are three forms of consents grant under the provisions of the Water (P & CP) Act 1974 and the Air (P & CP) Act 1981: –

  • Consent to Establish

Until beginning the work to establish the industry/activity, all industries and activities that require permission must first obtain consent to establish.

  • Consent to Operate

This consent must obtain prior to the start of actual development, including trial production. This permission is valid for a set period of time.

  • Consent to Operate Renewal

The consent to operate extend after a certain period has passed, then need to MPCB consent renewal.

APPROVAL TO START PROCEDURE (CONSENT TO ESTABLISH):

  • The applicant visits and register in http://www.ecmpcb.in/
  • At any point during the application process, applicants are not require to visit any of the MPCB offices. As part of the registration process, the online system includes one-time mobile verification for the applicant and one-time online document verification by the Department.
  • After registering, the applicant submits an application online.
  • The status of the application then changes to “Document Pending,” and four mandatory documents must be uploaded electronically before the status changes to “Payment Pending.” Industry will be required to pay fees online in accordance with the fees system available at http://www.mpcb.gov.in/consent-under-water-and-air-act#fees. When an application approve, the payment information must update, and the status changes to “Payment Approved.”
  • The application assign to the Field Officer by the SRO. The application status shifts to “In Process” after the field officer checks the application and pushes it into the Integrated Management Information System (IMIS). The field officer reviews the application, visits the industry (for establishment and first operations), and submits their recommendation / visit report to the Sub Regional Officer.
  • According to the delegation of authority, the application forwarded via IMIS based on the industry’s category and capital investment. Please see the following link: http://www.mpcb.gov.in/water-and-air-consent-act The application will be scrutinized by the relevant authority; if everything checks out, the application will approve in IMIS, and the status will update to “Approved” on the online portal, followed by the uploading of the signed consent copy. If the application is not acceptable, it is rejected in IMIS and the Entrepreneur is notified by marking the application status as “Rejected.” The consent copy can be downloaded from the online repository by industry.
